Description (English)
Intentional or negligent breaches of the duties listed in section 21, including placing products on the market without the required conformity assessment, missing declarations of conformity, markings or operating instructions, and breaches of retention and information duties, constitute administrative offences under section 28(1) no. 7 of the Product Safety Act. The Regulation does not specify a concrete fine amount.

Vorsätzliche oder fahrlässige Verstöße gegen die in § 21 genannten Pflichten, insbesondere das Inverkehrbringen ohne erforderliche Konformitätsbewertung, fehlende Konformitätserklärung, Kennzeichnung oder Betriebsanleitung sowie Verstöße gegen Aufbewahrungs- und Auskunftspflichten, stellen Ordnungswidrigkeiten nach § 28 Absatz 1 Nummer 7 des Produktsicherheitsgesetzes dar. Die Verordnung nennt keinen konkreten Bußgeldbetrag.
