Description (English)
An importer that exceeds the single mass-based threshold without being an authorised CBAM declarant is subject to a monetary penalty calculated on all embedded emissions in goods imported during the relevant calendar year. The competent authority may reduce the penalty where the threshold was exceeded by no more than 10% or where an authorisation application was refused. Payment releases the importer from submitting the declaration and surrendering certificates for those imports.
Description (German)
Ein Importeur, der die Einzelmassenschwelle überschreitet, ohne zugelassener CBAM-Anmelder zu sein, unterliegt einer Geldbuße auf Grundlage sämtlicher eingebetteter Emissionen der im maßgeblichen Kalenderjahr eingeführten Waren. Die zuständige Behörde kann die Geldbuße bei einer Überschreitung um höchstens 10 % oder bei einem abgelehnten Antrag auf Zulassung reduzieren. Die Zahlung befreit von der Erklärungspflicht und der Pflicht zur Abgabe von Zertifikaten für diese Einfuhren.
