Description (English)
An authorised CBAM declarant that fails to surrender the required certificates by 30 September is liable for a monetary penalty for each certificate not surrendered. The competent authority may reduce the penalty where incorrect information was provided by a third party, taking into account the duration, gravity, scope, intentional nature, repetition and cooperation. Payment does not release the declarant from surrendering outstanding certificates.
Description (German)
Ein zugelassener CBAM-Anmelder, der die erforderliche Anzahl von Zertifikaten nicht bis zum 30. September abgibt, muss für jedes nicht abgegebene Zertifikat eine Geldbuße zahlen. Die zuständige Behörde kann die Geldbuße bei fehlerhaften Informationen eines Dritten unter Berücksichtigung der Dauer, Schwere, Reichweite, Vorsätzlichkeit, Wiederholung und Kooperation reduzieren. Die Zahlung entbindet nicht von der Pflicht zur Abgabe der ausstehenden Zertifikate.
