Private employers may conduct, on their own responsibility and with participation of the works council, an in-company pay review procedure covering activities subject to the same pay system, consisting of a stock-take, an analysis using valid statistical methods (with data broken down by sex and personal data protected), and a results report, in order to check compliance of pay regulations and paid pay components with the equal pay requirement.

Private Arbeitgeber können in eigener Verantwortung und unter Beteiligung der betrieblichen Interessenvertretungen ein betriebliches Prüfverfahren durchführen, das die Tätigkeiten desselben Entgeltsystems einbezieht und aus Bestandsaufnahme, Analyse mittels valider statistischer Methoden (Daten nach Geschlecht aufgeschlüsselt, personenbezogene Daten geschützt) und Ergebnisbericht besteht, um die Einhaltung des Entgeltgleichheitsgebots zu überprüfen.
