Where the employer takes over the duty to answer information requests, or where a tariff-bound/tariff-applying employer has no works council, the employer must comprehensively and timely inform the works council or the representatives of the collective bargaining parties about incoming information requests and the given answers, and must inform employees who is providing the answer.

Übernimmt der Arbeitgeber die Erfüllung der Auskunftsverpflichtung oder besteht bei tarifgebundenen/tarifanwendenden Arbeitgebern kein Betriebsrat, hat der Arbeitgeber den Betriebsrat oder die Vertreterinnen und Vertreter der Tarifvertragsparteien umfassend und rechtzeitig über eingehende Auskunftsverlangen und die erteilten Antworten zu informieren und die Beschäftigten darüber zu informieren, wer die Auskunft erteilt.
