# Verordnung zum Schutz des Namens Solingen ### Eingangsformel Auf Grund des § 137 des Markengesetzes vom 25. Oktober 1994 (BGBl. I S. 3082) verordnet das Bundesministerium der Justiz im Einvernehmen mit den Bundesministerien für Wirtschaft, für Ernährung, Landwirtschaft und Forsten und für Gesundheit: ### § 1 Grundsatz Der Name Solingen darf im geschäftlichen Verkehr nur für solche Schneidwaren benutzt werden, die - 1. in allen wesentlichen Herstellungsstufen innerhalb des Solinger Industriegebiets bearbeitet und fertiggestellt worden sind und - 2. nach Rohstoff und Bearbeitung geeignet sind, ihren arteigenen Verwendungszweck zu erfüllen. ### § 2 Herkunftsgebiet Das Solinger Industriegebiet umfaßt das Gebiet der kreisfreien Stadt Solingen und das Gebiet der im Kreis Mettmann gelegenen Stadt Haan. ### § 3 Begriff der Schneidwaren Schneidwaren im Sinne des § 1 sind insbesondere: - 1. Scheren, Messer und Klingen aller Art, - 2. Bestecke aller Art und Teile von solchen, - 3. Tafelhilfsgeräte, wie Tortenheber, Gebäckzangen, Zuckerzangen, Traubenscheren und Vorleger, - 4. Tafelwerkzeuge, wie Zigarrenabschneider, Brieföffner, Nußknacker und Korkenzieher, sowie schneidende Küchenwerkzeuge, wie Dosenöffner und Messerschärfer, - 5. Rasiermesser, Rasierklingen und Rasierapparate, - 6. Haarschneidemaschinen und Schermaschinen, - 7. Hand- und Fußpflegegeräte, wie Nagelfeilen, Haut- und Nagelzangen, Nagelknipser und Pinzetten, - 8. blanke Waffen aller Art. ### § 4 Außerkrafttreten Diese Verordnung tritt an dem Tag außer Kraft, an dem das Amt der Europäischen Union für geistiges Eigentum auf der Grundlage eines gemäß Artikel 70 Absatz 2 der Verordnung (EU) 2023/2411 gestellten Antrags die hiernach geschützte Angabe in das Unionsregister nach der Verordnung (EU) 2023/2411 einträgt oder über den Antrag anderweitig abschließend entscheidet. Das Bundesministerium der Justiz und für Verbraucherschutz gibt den Tag des Außerkrafttretens im Bundesgesetzblatt bekannt. ### Schlußformel Der Bundesrat hat zugestimmt.
