# Verordnung über Ausnahmen von der Verordnung (EG) Nr. 999/2001 des Europäischen Parlaments und des Rates vom 22. Mai 2001 mit Vorschriften zur Verhütung, Kontrolle und Tilgung bestimmter spongiformer Enzephalopathien ### Eingangsformel Auf Grund des § 5 Nr. 1 und 4 des Fleischhygienegesetzes in der Fassung der Bekanntmachung vom 8. Juli 1993 (BGBl. I S. 1189), der zuletzt durch Artikel 1 Nr. 1 des Gesetzes vom 7. März 2002 (BGBl. I S. 1046) geändert worden ist, verordnet das Bundesministerium für Verbraucherschutz, Ernährung und Landwirtschaft: ### § 1 (1) Abweichend von Artikel 8 Abs. 1 Satz 1 in Verbindung mit Anhang V Nr. 4.1 Buchstabe a der Verordnung (EG) Nr. 999/2001 des Europäischen Parlaments und des Rates vom 22. Mai 2001 mit Vorschriften zur Verhütung, Kontrolle und Tilgung bestimmter spongiformer Enzephalopathien (ABl. EG Nr. L 147 S. 1), die zuletzt durch die Verordnung (EG) Nr. 746/2008 der Kommission vom 17. Juni 2008 (ABl. EU Nr. L 202 S. 11) geändert worden ist, muss ein Schlachtbetrieb Schädel ohne Unterkiefer, aber einschließlich Hirn und Augen, von Köpfen von über zwölf Monate alten Rindern nicht entfernen, wenn die betreffenden Köpfe - 1. unter Einhaltung der Anforderungen nach Artikel 8 Abs. 1 Satz 1 in Verbindung mit Anhang V Nr. 9 Buchstabe a bis d der Verordnung (EG) Nr. 999/2001 gewonnen und behandelt worden sind und - 2. unter amtlicher Überwachung in einen Zerlegungsbetrieb befördert werden sollen, dem eine Genehmigung nach § 2 Abs. 1 erteilt worden ist. (2) Die zuständige Behörde kann einem Schlachtbetrieb die Beförderung der in Absatz 1 genannten Köpfe untersagen, wenn die Anforderungen nach Absatz 1 nicht eingehalten werden. ### § 2 (1) Abweichend von Artikel 8 Abs. 1 Satz 1 in Verbindung mit Anhang V Nr. 4.1 Buchstabe a der Verordnung (EG) Nr. 999/2001 kann die zuständige Behörde auf Antrag Zerlegungsbetrieben die Gewinnung von Kopffleisch von Köpfen von über zwölf Monate alten Rindern genehmigen. (2) Die zuständige Behörde darf die Genehmigung nach Absatz 1 nur erteilen, wenn - 1. der Antragsteller - a) eine Darstellung des Arbeitsablaufes bei der Gewinnung von Kopffleisch - aa) in den Schlachtbetrieben, aus denen Köpfe zur Zerlegung in den Betrieb des Antragstellers befördert werden, und - bb) in dem Zerlegungsbetrieb, - b) im Zusammenhang mit der Einführung spezifischer Arbeitsbedingungen nach Artikel 8 Abs. 1 Satz 1 in Verbindung mit Anhang V Nr. 9 Buchstabe e Nr. iii der Verordnung (EG) Nr. 999/2001 Arbeitsanweisungen für alle Beschäftigten an Arbeitsplätzen, an denen Köpfe behandelt werden, unter Benennung - aa) der kritischen Arbeitsplätze und Arbeitsschritte, bei denen eine Verunreinigung von Fleisch mit spezifiziertem Risikomaterial möglich erscheint, und - bb) der dabei jeweils von einer möglichen Verunreinigung betroffenen Bereiche des Kopfes zur Prüfung vorlegt, - 2. der Antragsteller sicherstellt, dass die Anforderungen des Artikel 8 Abs. 1 Satz 1 in Verbindung mit Anhang V Nr. 9 Buchstabe e und f der Verordnung (EG) Nr. 999/2001 eingehalten werden, - 3. nach Prüfung der vorgelegten Unterlagen nach Nummer 1 Buchstabe a und b eine Verunreinigung von Fleisch mit spezifiziertem Risikomaterial ausgeschlossen ist. Die Genehmigung nach Absatz 1 ist unter dem Vorbehalt zu erteilen, sie zu widerrufen, wenn die Anforderungen des Satzes 1 nicht mehr erfüllt sind. Die Genehmigung kann, auch nachträglich, mit Auflagen verbunden werden, soweit dies erforderlich ist, die Einhaltung der Anforderungen des Satzes 1 sicherzustellen. (3) Die zuständige Behörde hat die Genehmigung, unbeschadet der dem § 49 des Verwaltungsverfahrensgesetzes entsprechenden landesrechtlichen Vorschriften, nach Absatz 1 zu widerrufen, wenn die Anforderungen des Absatzes 2 Satz 1 nicht mehr erfüllt sind. ### § 3 Diese Verordnung tritt am Tage nach der Verkündung in Kraft. ### Schlussformel Der Bundesrat hat zugestimmt.
